Quantifying the dimensions of the dispute to be resolved, including:
- Collecting the facts of the dispute including the respective positions and rationale of the parties
- Analyzing the facts of the dispute and the position of the parties
- Identifying a qualified neutral party for performing a neutral evaluation of the facts of the dispute and developing possible resolutions
- Identifying applicable advisory or improved ADR methods.
The foregoing work will be directed towards achieving improvements to the quantification of the dimensions of the dispute through expert consultation and support from highly experienced litigation support experts.
Identification and implementation of appropriate ADR approaches for particular situations, including:
- Negotiated rulemaking
- Joint problem solving
- Partnering
- Consensus building
- Neutral experts
- Mediation and conciliation
- Arbitration (binding and non-binding)

- Identifying specific parties associated with (b) through (j), above.
The foregoing work will be directed towards achieving improvements to the identification and implementation of appropriate ADR approaches through expert consultation and support from highly experienced litigation support experts.
Expert testimony in connection with ADR processes in contractual, technical (particularly nuclear) and cost and economic analysis considerations associated with a dispute. This work will be directed towards achieving improvements to supporting positions of the Government through expert testimony.
Performance of early neutral evaluations and/or acting as neutral experts in connection with ADR activities (to the extent that JAI was not otherwise involved in supporting the Government in the particular dispute). This work will be directed towards achieving program improvements to the ADR process through highly experienced experts in contract, technical, and economic analysis matters.
